PDT Help Client Halt Director Disqualification Proceedings
Published: 15 November 2021
In 2018 one of the country’s largest government funded apprenticeship providers collapsed into liquidation. The Insolvency Service commenced an investigation into the cause of the collapse with a view to bringing disqualification proceedings against its directors. We advised one of the directors during the lengthy investigation which resulted in The Insolvency Service discontinuing its investigation and the threat of a claim.
Our client commented: “Justin’s intervention on my behalf was impressive and invaluable. His experience in dealing with these investigations meant that I presented my case in the most advantageous way possible, drawing out all the relevant details and mitigating facts which The Insolvency Service needed to be made aware of. Some of them would never have occurred to me, but when presented in the round, Justin made a very convincing case in my defence. My accountancy career was put on the line but now I am free to continue with my practice. I am indebted to Justin and PDT for putting an end to my sleepless nights!”
Justin commented: “Our client had acted commendably in accordance with his duties as a director but his professional livelihood and reputation was at stake. We assisted the client in responding to The Insolvency Service’s barrage of questions over a period of almost 18 months. I was delighted when the outcome was confirmed that The Insolvency Service would not be taking any further action against our client, because he simply had no case to answer.”
Contact Justin if you are a director of a company which is being investigated by The Insolvency Service. An early intervention is advisable to stave off the disastrous consequences of a director’s disqualification and costly litigation.
